Who is responsible for damage to a sidewalk caused by a neighbor's tree?
Q. If someone plants a tree on a sidewalk close to a neighbor's property, and the tree roots grow under the neighbor's sidewalk causing the sidewalk to heave, and/or damage underground pipes, who has legal liability for property damage and/or injuries caused by this situation? If the person who originally planted the tree sells his property and moves, and damage is later caused as the result of the tree roots, does he still have the liability, or does the liability go the one who currently owns his former property? Is there any liability to the municipality if they were informed of the hazard but chose not to do anything about it?

A. I would think being the house and property was sold it may go to the new owners as the older owner is now gone .If they refuse to pay and get it fixed hopefully before someone trips and gets real hurt like i did breaking a leg on a up rooted sidewalk due to old tree roots..If needed go to the courthouse and take them to court but maybe your newer neighbor will not want people to have To always worry about 6the mess and how not to get hurt .

What do I need to start selling sidewalk portraits?
Q. I'm an artist in North Carolina. I'd like to start my own small business; I'm planning to sit outside near the beach and draw portraits for people. I've been told I need a federal tax ID number. Someone else said I only need a state tax ID number, but those don't exist as far as I can tell. The same person said I would need an ambulatory vendor's license. Does anyone else do sidewalk art? What do I need to start?

Q. The sidewalk to my front door is old and has sunk to below or at ground level next to a mostly dirt covered area under a tree. Every time it rains the area right in front of my door floods and gets muddy. We just moved here and can't replace it yet. What can we do for a quick fix until next summer?

What kind of shade tree should I plant next to the sidewalk?
Q. Our house is really close to the sidewalk and we lost a big maple that provied a lot of shade on the 2nd story. The sidewalk is 5 feet from the road and our house.

A. I would try growing another Maple tree. Most maples grow fast, but it would be quite a few years before you got shade for the second story. Silver or Red Maples would be a good shade tree.

How to stop a dog from pooping on the sidewalk?
Q. I have a 14 year old Labrador Retriever Mix and she recently started this habit of pooping while walking. She does not have a uncontrollable bowel or bladder problem because she does not do it in the house often. How can I stop her from pooping on the sidewalk and instead go to the grass when she feels the need to poop?
Asked by iluvdogs - Sun Jul 6 15:12:33 2008 - - 6 Answers - 0 Comments

A. If you see her start to poop on the sidewalk, move her over to the grass. Praise her when she goes on the grass and give her a treat. Tell her no when she goes on the sidewalk. You can train her to go in the right place. Because of her age it just might take her longer. Remember to bring some baggies with you until you get this habit gone!

A. Before you put a shovel in the ground, make sure you know where the gas, cable, power service, and phone lines are buried! Most companies will "locate" their lines for free, but bill you for repairs if dig into their stuff without calling. If you remove any fill from under the side walk, refill with sand or pea gravel. It won't settle, and cause the sidewalk to crack or break. You can drive a steel pipe from one hole next to the walk to another hole on the other side with a large hammer. Cap the "dirt end of the pipe to keep it from filling up. Hold a a block of wood between the end of the pipe and the hammer, to protect the pipe from damage. A slight angle is good, to keep the pipe from holding water, when it rains You can… [cont.]

How can I stop neighborhood dogs from peeing on my sidewalk in front of my house?
Q. I've tried Cayenne pepper and washing the sidewalk with water and bleach to get rid of the smell so other dogs don't add to the problem and the repeat canine offender...Nothing works. Any other suggestion? I can't put up a fence and I never see the owner with the dog. Any suggestions would be appreciated.

A. Call your local authorities. Most states/cities have leash laws. Why don't you leave a message on your neighbor's door if you never see them. Or you can rent a have-a-heart trap from your local shelter and trap the dog and send it down the road to your animal shelter.

Do these businesses need a permit or can they just go for it? If you do need a permit, any information about how to get one is helpful!

Can you park with sidewalk on your left?
Q. For example you want to park on the left side of the road, but instead of turning around so that it's on your right side, you just park so that the sidewalk is on your left. You probably can't do that on main roads and avenues? But what about just residential streets with no lanes? I've seen people park to the sidewalk on the left in US. But I don't think I've seen cars parked like that in Canada which is where I live. Is it against the law here?

Can you lay asphalt over a section of concrete sidewalk?
Q. Can I put a base layer of gravel over the sidewalk and just have blacktop laid over top? Or do I have to remove the sidewalk before putting down the asphalt? The driveway is currently gravel, with a 40 foot section of sidewalk along the house. I'd like to have the drive black topped, but I don't want to break up and remove the sidewalk if I don't have to do it. Let me clarify, the sidewalk is not city property, it's a sidewalk between my garage and house, not leading to a city street.
Asked by Joe - Mon Jul 27 13:17:19 2009 - - 2 Answers - 0 Comments

A. If you have been driving over this sidewalk all along, then you could probably do as you say. However if the dirt right next to the sidewalk has not been driven on and is in fact soft, I would expect that you would then compact the soil and crack the asphalt at the edge of the concrete on each side.

A neighbour came out and sprinkled salt over the slide which soon stopped our fun. Gosh, that was 60 years ago but I still felt a surge of anger at her spoiling our fun!!
